These Terms of Service ("Terms") apply to all orders placed through femonparts.eu and our affiliated brand domains (yamahamotorcycle-parts.com, kawasakimotorcycle-parts.nl, suzukimotorcycle-parts.com, ktmmotorcycle-parts.com).

These Terms apply to consumers only. Business customers (dealers, garages, trade accounts) are subject to separate dealer terms.

By placing an order you confirm that you have read, understood and accepted these Terms.

2. Definitions

In these Terms:

      "Customer", "you" means the consumer placing an order.

      "Order" means a request to purchase products through our website.

      "Products" means the motorcycle parts, accessories and apparel offered for sale.

      "Website" means femonparts.eu and our affiliated brand domains.

3. Products and product information

We sell original equipment manufacturer (OEM) and aftermarket parts, accessories and apparel for motorcycles.

We make every effort to display product information, images, specifications and fitment data as accurately as possible. However:

      Images are illustrative and may differ slightly from the actual product (colour, packaging, revision).

      Fitment information is based on data provided by manufacturers and suppliers. Although we work to keep this current, errors may occur.

      Product specifications, part numbers and revisions can be changed by the manufacturer without prior notice.

      Stock levels shown on the website are indicative and based on supplier information. In rare cases stock may be unavailable after you place your order, in which case section 7 applies.

4. Fitment and compatibility

You are responsible for verifying that the part fits your specific motorcycle before installation. We strongly recommend:

      Cross-checking the OEM part number on the original part you are replacing

      Verifying year, make, model and engine variant against our fitment data

      Contacting us at info@femon.nl if you are unsure

If you order an incorrect part because the wrong vehicle data was selected by you, the standard return policy applies (see Return and Refund Policy). The cost of return shipping in such cases is for your own account.

If we have provided incorrect fitment information that led to the wrong part being delivered, we will treat this as an incorrect delivery (see Return and Refund Policy, section "Defective or incorrectly delivered product").

5. Prices and payment

All prices on the website are shown in euros (EUR), including 21% VAT, unless otherwise stated. Shipping costs are added at checkout and shown before you confirm your order.

We accept the payment methods displayed at checkout. Payment is processed at the time of order placement. The order is only binding once payment has been received and confirmed by us.

Pricing errors: Despite our care, prices on the website may occasionally contain errors (for example a missing decimal, incorrect currency conversion, or system fault). If we discover that a product was offered at a clearly incorrect price (which a reasonable customer should have recognised as an error), we reserve the right to:

      Cancel the order and refund the full amount paid, or

      Contact you to confirm whether you wish to continue at the corrected price.

This applies in particular to prices that deviate by more than 30% from the normal market price.

6. Order acceptance and contract formation

When you place an order, you receive an order confirmation by email. This confirmation acknowledges that we have received your order; it is not yet acceptance of the order.

The contract between you and us is formed only when:

      We have received payment, and

      We dispatch the products and send a shipping confirmation.

We reserve the right to refuse or cancel any order before dispatch, including but not limited to:

      Suspected fraud or unauthorised payment

      Pricing errors (see section 5)

      Stock unavailability

      Delivery to a region we do not service

      Repeated returns or abuse of consumer rights

In such cases you will receive a full refund within 14 days.

7. Stock and availability

Although stock levels are kept up-to-date as accurately as possible, our systems rely on data from suppliers (including Parts Europe and brand-specific suppliers). In rare cases, an item may turn out to be out of stock or discontinued after you have placed your order. In such cases we will:

      Notify you by email as soon as possible

      Offer you a comparable alternative (if available), or

      Cancel the order and refund the full amount within 14 days

We are not liable for any further damages arising from stock unavailability beyond refunding the purchase price.

8. Delivery

We deliver to addresses within Europe as listed at checkout. Delivery times displayed on the website are estimates, not guarantees.

Delivery times start from the moment of dispatch (after payment confirmation and order processing). We are not responsible for delays caused by:

      The carrier (PostNL, DHL, DPD, UPS or other)

      Customs inspections for non-EU destinations

      Force majeure events (see section 13)

      Incorrect or incomplete address information provided by you

Risk of loss or damage transfers to you at the moment of delivery to the address you provided. If a parcel is reported as delivered but you have not received it, please contact us within 7 days so we can open an investigation with the carrier.

9. Installation and use of products

Important — installation by qualified mechanic: OEM and aftermarket motorcycle parts are intended to be installed by a qualified mechanic in accordance with the manufacturer's service manual.

You are solely responsible for:

      Correct installation of the product

      Following manufacturer torque specifications, fluid types and procedures

      Verifying compatibility with other components on your motorcycle

      Compliance with road traffic regulations and type-approval requirements in your country

We are not liable for any damages, injury, loss or consequential damages arising from:

      Incorrect installation by you or a third party

      Use of the part outside its intended purpose

      Use of the part in racing or competition (where the manufacturer excludes such use)

      Modifications made to the product after delivery

      Failure to observe manufacturer instructions

This limitation does not affect your statutory rights under Dutch consumer law where these cannot be excluded by contract.

10. Right of withdrawal and returns

You have the right to withdraw from your purchase within 14 days of receipt under EU Directive 2011/83/EU. Full conditions, exclusions and the procedure for returning goods are set out in our separate Return and Refund Policy, which forms part of these Terms.

11. Warranty

In addition to your right of withdrawal, the statutory warranty under Dutch law applies to all products. A product must do what you can reasonably expect from it.

For specific manufacturer warranties (such as Beta, Sherco, Fantic, SWM and others) the conditions of the relevant manufacturer apply in addition to your statutory rights.

To make a warranty claim, contact us at info@femon.nl with your order number, a description of the issue and photos where applicable.

12. Liability

To the extent permitted by law, our total liability under or in connection with any order is limited to the purchase price of the relevant product.

We are not liable for:

      Indirect or consequential damages, including loss of use of the motorcycle, loss of income, towing costs or rental costs

      Damages arising from incorrect installation (see section 9)

      Damages caused by use outside the product's intended purpose

      Damages caused by modifications made after delivery

This limitation does not apply to:

      Damages caused by our intent or gross negligence

      Death or personal injury caused by our negligence

      Liability that cannot be excluded under mandatory consumer protection law

13. Force majeure

We are not liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to:

      Strikes, lockouts or industrial disputes

      War, terrorism, civil unrest

      Natural disasters, severe weather, fire, flood

      Pandemic or epidemic

      Government actions, import or export restrictions

      Failures of suppliers, carriers or payment processors

      Internet, network or power outages

If a force majeure event continues for more than 30 days, either party may cancel the affected order and we will refund any amount already paid.

14. Intellectual property

All content on our website (text, images, logos, design, code) is owned by us or our licensors and is protected by copyright and other intellectual property laws.

Brand names, logos and trademarks of manufacturers (Yamaha, Kawasaki, Suzuki, KTM, Beta, Sherco, Fantic, SWM and others) are the property of their respective owners. We use these solely to identify products and indicate fitment, in accordance with applicable trademark law.

You may not copy, reproduce, scrape, modify or redistribute any part of our website without our prior written consent.

15. Privacy and data protection

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy, which forms part of these Terms.

16. Complaints

If you have a complaint, please contact us first at info@femon.nl. We will respond within 14 days and aim to resolve the issue together.

If we cannot reach a solution, you may submit your complaint to the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

17. Governing law and jurisdiction

These Terms are governed by Dutch law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

Any dispute arising from or in connection with these Terms or any order will be submitted to the competent court of the district of The Hague (Rechtbank Den Haag), the Netherlands. As a consumer, you also retain the right to bring proceedings in the courts of the EU member state in which you reside.

18. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the version published on our website at the time you placed the order.

Material changes will be communicated via our website. Continued use of the website after changes are published constitutes acceptance of the new Terms for future orders.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force. The invalid provision will be replaced by a valid provision that comes closest to the original intent.
